This Terms of Service agreement ("Agreement") governs your use of any BigCommerce apps ("App"), provided by "Groove Commerce" ("Provider"). By using the App, you agree to be bound by the terms and conditions set forth in this Agreement.

1. Acceptance of Terms

By accessing and using the App, you acknowledge that you have read, understood, and agreed to comply with this Agreement and any other applicable laws, rules, and regulations.

2. Description of Services

The specific features, functionality, and limitations of the App are described on the Provider's app-specific website pages as well as on the BigCommerce app marketplace.

3. User Responsibilities

a. Account Creation:

You must create an account to use the App. You are responsible for maintaining the confidentiality of your account information and ensuring the security of your login credentials.

b. Acceptable Use:

You agree to use the App in compliance with all applicable laws and regulations. You will not use the App for any unlawful, unauthorized, or fraudulent activities.

c. Data Accuracy:

You are responsible for the accuracy and integrity of the data you input and modify using the App.

4. Intellectual Property

a. Ownership:

The Provider retains all ownership rights to the App, including any intellectual property rights associated with it.

b. License:

The Provider grants you a limited, non-exclusive, non-transferable license to use the App solely for its intended purpose, in accordance with this Agreement.

5. Data Privacy and Security

The Provider respects your privacy rights and handles personal information in accordance with its Privacy Policy. By using the App, you acknowledge and consent to the Provider's collection, use, and disclosure of personal information as described in the Privacy Policy.

6. Limitations of Liability

a. No Warranty:

The App is provided "as is," without any warranties, express or implied. The Provider does not guarantee the availability, accuracy, or reliability of the App.

b. Limitation of Liability:

To the extent permitted by law, the Provider shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to the use or inability to use the App.

7. Termination

The Provider reserves the right to suspend or terminate your access to the App, without prior notice, for any reason, including violation of this Agreement.

8. Amendments

The Provider may modify this Agreement at any time, and such modifications will be effective upon posting the updated version on the Provider's website. Your continued use of the App after the modifications constitute your acceptance of the revised Agreement.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the United States of America. Any disputes arising out of or in connection with this Agreement shall be resolved through binding arbitration or mediation, in accordance with the applicable rules.
